1) Scope of Application
1.1 These Terms and Conditions (GTC) set forth by BG Investment GmbH (“Seller”) govern all agreements between the Seller and any buyer (“Client”) concerning the purchase of goods and services from the Seller’s online store. The Client’s own terms and conditions are not recognized unless explicitly agreed upon.
1.2 Use of the Seller’s website signifies the Client’s acceptance of these GTC.
1.3 The Seller may update or modify these GTC at any time, notifying Clients of significant changes at least 30 days in advance. Continued use of the Seller’s services after such changes constitutes agreement to the revised terms.
1.4 The Client consents to electronic access, signature, and storage of documents in accordance with the E-SIGN Act, UETA, and relevant state laws. The Client’s electronic signature carries the same legal effect as a physical signature.
2) Conclusion of the Contract
2.1 Product listings in the Seller’s online store do not constitute binding offers but invite Clients to submit purchase proposals.
2.2 The Client submits an offer by completing the online order process and finalizing it with the relevant confirmation button.
2.3 The Seller may accept the offer within five days through:

A written confirmation (email, fax, or other text form);

Shipping the goods, making their receipt by the Client decisive;

Requesting payment from the Client after the order is placed.
If the Seller does not accept within this period, the Client is no longer bound by the offer.
2.4 The acceptance period starts the day after the Client submits the offer and expires on the fifth day thereafter.
2.5 The contract details will be stored and shared with the Client via email or other written formats.
2.6 The Client can review and correct entered data before submitting an order.
2.7 The contract language is exclusively English.
3) Return Policy
The Client has 30 days after receiving an item to request a return.
To initiate a return, contact us at support@petstorehomes.com. If approved, a return label and instructions will be provided. Unrequested returns will not be accepted.
Returns are not accepted for sale items or gift cards.
Eligibility requirements:

Items must be unworn/unused, with tags and in original packaging.

A receipt or proof of purchase is required.

Damages & Issues: Please inspect orders upon arrival and report defects, damage, or incorrect items immediately.
Non-returnable Items: Perishable goods, customized products, personal care items, hazardous materials, flammable liquids, and gases.
Refunds: If a return is approved, the refund will be issued via the original payment method within 10 business days. If more than 15 business days have passed since approval, contact us at support@petstorehomes.com.
4) Price and Delivery Costs
4.1 Prices are displayed in USD, excluding taxes and shipping fees. If an item is mispriced, the lower price will be honored unless it is a significant error, in which case the Seller will either contact the Client or cancel the order.
4.2 For deliveries to the U.S., additional costs such as transfer fees, taxes, or customs duties may apply and must be covered by the Client.
4.3 Payment options are listed in the Seller’s online shop.
5) Shipment and Delivery Conditions
5.1 Orders are shipped to the address provided by the Client unless otherwise agreed.
5.2 If an item is unavailable, the Seller will notify the Client. The Client may choose a substitute item or cancel the order for a refund.
5.3 If delivery is unsuccessful and the product is returned to the Seller, the Client bears the cost of reshipping.
6) Warranty
The Seller disclaims implied warranties of merchantability or fitness for a particular purpose. The Seller is not liable for indirect, special, or consequential damages. Liability will not exceed the purchase price of the item in question.
Some jurisdictions do not allow the exclusion of implied warranties, in which case exclusions are limited to the extent permitted by law.
7) Limitation of Liability Regarding the Use of the Seller’s Online Shop
7.1 The Seller’s online shop is provided “as is” and “as available” without warranties of any kind.
7.2 The Seller is not responsible for losses due to viruses, access errors, or material downloaded from the site.
7.3 External website links provided on the Seller’s site are for reference only. The Seller holds no responsibility for their content or policies.
7.4 Some jurisdictions may not allow liability exclusions; such exclusions are limited as required by law.
8) Limitation of Action
Any claim related to this contract must be initiated within 12 months of when it could have reasonably been discovered.
9) Governing Law
All legal matters are governed by the laws of the State of Illinois, excluding the UN Convention on Contracts for the International Sale of Goods.
10) Designation of Forum
Any legal proceedings must be initiated in the state where the Seller operates. Both parties consent to the exclusive jurisdiction of these courts.
